Loaner Vehicle Agreement

2. Purpose and Term

The Loaner Vehicle is provided to the Lessee for personal use only, solely for the duration of the repair of the Lessee's vehicle by Eastern Auto Works. The term of this Agreement begins on the lease out date specified below and ends upon the completion of repairs or earlier termination as outlined herein, whichever occurs first.

3. Rental Fees

The Lessor provides the Loaner Vehicle at no cost to the Lessee, provided the Lessee complies with all terms of this Agreement.

In the event of damage to the Loaner Vehicle caused by the Lessee's negligence or misuse, the Lessee agrees to pay all repair costs as determined by Eastern Auto Works.

4. Insurance and Liability

• The Lessee represents that they maintain a valid auto insurance policy that provides primary coverage for the operation of the Loaner Vehicle, as required under Md. Code Regs. 11.18.01.03.
• The Lessee agrees to provide proof of insurance to the Lessor upon request.
• The Lessee is responsible for any damage, loss, or liability arising from their use of the Loaner Vehicle, except for normal wear and tear.
• The Lessor maintains a liability insurance policy or self-insurance certification as required by Maryland law, but this does not relieve the Lessee of responsibility for damages caused by their actions.

5. Use of Loaner Vehicle

The Lessee agrees to:

• Be at least 21 years of age and hold a valid driver's license as required by Maryland law.
• Use the Loaner Vehicle only for personal, non-commercial use on properly maintained roads and parking lots.
• Comply with all applicable Maryland laws, including those related to licensure and vehicle operation.
• Not sublease the Loaner Vehicle, use it as a vehicle for hire, or allow any other person to operate it. Only the undersigned Lessee is authorized to operate the Loaner Vehicle.
• Not operate the Loaner Vehicle in a negligent or illegal manner.
• Be solely responsible for any traffic violations, including but not limited to parking tickets, speeding tickets, or other citations, incurred while operating the Loaner Vehicle, and for any tolls accrued during the use of the Loaner Vehicle.
• Return the Loaner Vehicle in the same condition as received, except for normal wear and tear, with at least the same amount of fuel as provided at the start of the Agreement.

8. Prohibited Activities and Cleaning Fee

The Lessee agrees to:

• Not use, consume, or allow the use or consumption of drugs, alcohol, or any smoking products (including but not limited to cigarettes, cigars, vaping devices, or marijuana) within the Loaner Vehicle.
• Not allow food or drink within the Loaner Vehicle.
• Not allow pets inside the Loaner Vehicle.

In the event that stains, odors, or damages are found in the Loaner Vehicle resulting from the use of drugs, alcohol, smoking, food, or drink, the Lessee will be responsible for a cleaning fee of $100, in addition to any repair costs for damages as determined by Eastern Auto Works.

In the event that stains, odors, or damages are found in the Loaner Vehicle resulting from the presence of pets, the Lessee will be responsible for a cleaning fee of $150, in addition to any repair costs for damages as determined by Eastern Auto Works.

9. Maintenance and Repairs

• The Lessor is responsible for routine maintenance of the Loaner Vehicle.
• The Lessee must immediately report any mechanical issues or damage to Eastern Auto Works at 443-521-9655 or easternautoworks@gmail.com
• Unauthorized repairs by the Lessee are prohibited.

10. Return of Vehicle

• The Lessee agrees to return the Loaner Vehicle to Eastern Auto Works at 2940 Old Route 50, Cambridge, MD 21613 upon completion of repairs to the Lessee's vehicle or upon request by the Lessor.
• Failure to return the Loaner Vehicle within 48 hours of notification of repair completion may result in a daily fee of $50.00 until returned.
• The Lessor is not responsible for any personal belongings left inside the Loaner Vehicle at the time of return. The Lessee acknowledges that any items left in the vehicle are at their own risk, and Eastern Auto Works will not be liable for their loss or damage.

11. Termination

• The Lessor may terminate this Agreement immediately if the Lessee violates any terms herein or if the Lessee's vehicle repairs are completed.
• The Lessee may terminate this Agreement by returning the Loaner Vehicle to Eastern Auto Works in the agreed-upon condition.

12. Governing Law

This Agreement is governed by the laws of the State of Maryland. Any disputes arising under this Agreement shall be resolved in a court of competent jurisdiction in Maryland.

13. Inspection

• The Lessee acknowledges they have inspected the Loaner Vehicle and found it in good condition, except as noted in the attached Existing Damage Document (if applicable).
• The Lessee agrees to a joint inspection with the Lessor upon return of the Loaner Vehicle to document its condition.

14. Entire Agreement

This Agreement constitutes the entire understanding between the Lessor and Lessee. No amendments or waivers are valid unless made in writing and signed by both parties.

15. Violation of Contract Terms

Any violation of the terms of this Agreement by the Lessee may result in additional fees, as determined by the Lessor, Eastern Auto Works, in addition to any other remedies available under this Agreement or applicable law.
